TERMS OF SALE

Feather & Fire Systems

Last Updated: October 10, 2026

These Terms of Sale ("Terms") govern every purchase from Feather & Fire Systems ("Feather & Fire Systems," "we," "us," or "our"), including digital products, personalized services, and subscription-based services, wherever the purchase is made — our website, our checkout and payment links, or a third-party marketplace that carries our products. By completing a purchase, you agree to these Terms.

These Terms work alongside our other policies, which form part of your purchase agreement: our Refund & Cancellation Policy, our Digital Product License (for digital products), our Personalized Services Terms (for personalized services), and our Privacy Policy.

1. WHO MAY PURCHASE

You must be at least 18 years old, or the age of majority where you live, and legally able to enter into contracts, to purchase from us. If you purchase on behalf of a business, you represent that you are authorized to bind that business.

2. PRODUCTS AND SERVICES WE SELL

We sell:

Digital products — downloadable or electronically delivered products, licensed (not sold) to you under our Digital Product License.

Personalized services — services we perform or configure for your business under our Personalized Services Terms.

Subscription services — services billed on a recurring basis for so long as the subscription remains active.

Descriptions of what is included in a purchase appear on the applicable product page, checkout page, offer, or written agreement. Those descriptions — including what is expressly not included — are part of these Terms for that purchase. Anything not stated as included is not included.

3. PRICES AND TAXES

Prices are shown at the point of purchase in U.S. dollars unless stated otherwise.

We may change prices for future purchases at any time. A price change never changes the amount owed for a purchase already completed, and never changes a recurring charge without notice to active subscribers before the change takes effect.

Where we are required to collect sales tax or other transaction taxes, those amounts will be added at checkout or invoiced. If a purchase is made through a third-party marketplace, that marketplace may calculate and collect taxes under its own policies.

4. ORDERS AND ACCEPTANCE

Your order is an offer to purchase. A contract is formed when we accept the order, which occurs when payment is successfully processed and we make the product available or confirm the service order.

We may decline or cancel an order — before delivery where possible — in cases of suspected fraud, payment failure, pricing or description errors, or if we cannot fulfill the order. If we cancel an order for a reason other than your breach and you have been charged, you will be refunded in full for that order.

Keep your order confirmation and receipts; they are your proof of purchase and of the license or service you acquired.

5. PAYMENT

Payment is processed by third-party payment processors. We do not store your full payment card details.

By purchasing, you authorize the charges presented at checkout, including recurring charges for subscriptions, until cancelled under our Refund & Cancellation Policy.

You are responsible for maintaining a valid payment method for any recurring service. If a recurring charge fails, we may retry it, contact you, and/or suspend the service until payment is resolved.

Third-party costs (software, platforms, messaging or usage charges, advertising, and similar) are not included in our prices unless expressly stated in writing.

6. DELIVERY

Digital products are delivered electronically — by download, email, or account access. Delivery is complete when the files or access are made available to the email address or account used at purchase. You are responsible for providing a correct email address and for downloading and safely storing your files.

Personalized services are delivered as described in our Personalized Services Terms, generally by electronic delivery. Timelines are confirmed in writing for each project before payment.

Subscription services begin or renew as described at purchase.

Risk of loss for digital files passes on delivery; keeping backup copies of your files is your responsibility, subject to the replacement help described in our Refund & Cancellation Policy.

7. MARKETPLACE PURCHASES

If you purchase through a third-party marketplace (such as an online marketplace store), that marketplace's terms and policies also apply to that transaction (for example, its payment and buyer-protection rules). Where a marketplace policy conflicts with these Terms for that transaction, the marketplace policy controls that transaction; our Digital Product License still governs your use of the product itself.

8. ACCEPTABLE USE

Purchases are for the purchasing business's own use. Resale, redistribution, or transfer of our products, files, or deliverables — except as expressly permitted in our Digital Product License — is prohibited and may result in termination of your license and access without refund where permitted by law.

9. NO GUARANTEED RESULTS

Our products and services provide systems, tools, and implementation. We do not guarantee any specific business results, including leads, customers, sales, revenue, profits, or time savings. Results depend on factors outside our control, including your market, offers, and how the products or services are used.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

Our total liability arising from or related to any purchase is limited to the amount you paid for the product or service giving rise to the claim.

We are not liable for indirect, incidental, special, consequential, or lost-profit damages.

Nothing in these Terms limits liability that cannot lawfully be limited.

11. DISPUTES AND GOVERNING LAW

These Terms, and any purchase, are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.

If a dispute arises, both sides agree to first try to resolve it informally and in good faith by contacting us at support@featherandfiresystems.com. If informal resolution fails, the dispute will be brought in the state or federal courts located in Wells County, Indiana (or the federal district covering it), and both sides consent to that venue, unless applicable law requires otherwise.

12. CHANGES TO THESE TERMS

We may update these Terms from time to time. The version in effect on the date of a purchase governs that purchase. Continued purchases after an update constitute acceptance of the updated Terms for those purchases.

13. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. These Terms, together with the policies and descriptions referenced in them, are the entire agreement between you and Feather & Fire Systems regarding purchases, and supersede prior discussions about the same subject.
